Most judges and state laws are more inclined to give children to their mothers, so it will be hard, but if you sell the situation right, you'll probably get part or full custody of your son. There's no way a judge will let a woman like that keep your son full time. Even here in California I know a man who got full custody of his son even though his wife had a full-time job.

First, don't stop paying her but do go to child support and have an order drafted that shows how much you are required to pay. As the other person stated, everything you are paying right now is considered a gift. Don't stop giving it to her though because then you are not showing you are interested in taking care of your child. If child support orders back support, hire an attorney immediately. They can show you have been paying and cancel out your back support. It is almost impossible to fight child support on your own and win though.



You need to file for joint custody immediately! You should be entitled to your child just as much as she is.



Just a tip, stop complaining about what your ex does as far as money. It makes you seem childish. I know where you are coming from and I completely understand, but courts don't like to see that! Also, you need to try to be cordial with her because you two will be spending the rest of your lives as a family, even though seperately. If you two can't get along the only person you hurt is your child! He doesn't deserve that.



PS- when you want to convince people you are the better parent, you might want to consider a better screen name, lol, that looks pretty bad!

Wow, your first mistake, giving her 500 bucks a month.DON'T! It is not considered child support...it is considered a gift.She could still go after you for backed child support if she wishes since the money you were giving her was not court ordered.



You need to get yourself down to the courthouse as soon as possible and file for joint custody and child support.You want to be the first to file so it shows that you are trying to be responsible on your part.You also want to hurry along with that so she doesn't file for backed support.



It really is up to the judge on whether you get joint custody or not but if you are fit, you will for sure get at least visitation rights (press for joint though)



I wouldn't go for full custody...it more than likely won't be granted and it might make you look out to be a Villon.



Make sure you go down ASAP and get the ball rolling on this so you do not miss out on a moment of your son's life.

No you would not get full custody 97% of the cases the mother wins. But from what you have written she should give you atleast joint custody and she cant be treating you that way making you pay for her bills and not letting you share responsibility unless you are a drunk or a druggie then she doesn't have to be around when you are with your son. If you have been paying her that money and he has your last name then for sure I am 100% percent positive the judge would grant you joint custody and you shouldn't want to take him away from her completely even though that's what she is trying to do a child needs both of his parents not just one. And yall should put your personal problems aside and make this work out for your child and his best interest.

No. It would take more than that to make her an unfit mother. And the judge would have to have alot of reasoning to overturn custody. Almost impossible.

Hope you either wrote her a check for the money you gave her or made her sign a reciept or she is gonna tell the judge you have not given her anything. Also take the medical bills to court with you showing that you paid them in full. Half is all your responsible for the other half is on her.



If she makes it look like you are not doing anything and making her pay everything she will mop the floor with you. If you look like you have to pay everything and she is broke it will help your cause. I can not imagine a judge not giving you at least partial custody if you are a decent person clean record pending a dnat test. I would go for full too though if she just sits around all day wishing she was a house wife. If a woman could not work before she got pregnat what makes anyone think she will work hard to take care of the kid.
